§1. General provisions

1. These Terms of Use set out the rules for using the website available at https://westmarhydraulics.pl/, hereinafter referred to as the "Website", and the rules for the provision of services by electronic means through it.

2. The owner and administrator of the Website, and the service provider providing services by electronic means, is:

4. The Terms of Use are made available to Website users free of charge in a manner enabling them to read, save and reproduce it.

5. Starting to use the services provided through the Website means that the user must comply with the provisions of these Terms of Use.

§2. Definitions

For the purposes of these Terms of Use, the following meanings of terms are adopted:

Website – the website operating at westmarhydraulics.pl together with its subpages.

Service Provider – WestMar Hydraulics Kantor, Wieczorek spółka komandytowa.

User – any person using the Website.

Electronic service – a service provided electronically through the Website, in particular making the content of the Website available, the contact form and the recruitment form.

Contact form – a Website feature enabling a message or inquiry to be sent to the Service Provider.

Recruitment form – a feature enabling the submission of an employment-related application, including candidate data and application documents.

§3. Types and scope of services provided

1. Through the Website, the Service Provider provides free of charge electronic services including in particular:

  • enabling browsing of content available on the Website,
  • presenting information about the Service Provider,
  • presenting WestMar Hydraulics' products and services,
  • presenting information about the company's activities,
  • enabling the use of the contact form,
  • enabling inquiries regarding products, services and cooperation to be sent,
  • enabling the use of the recruitment form,
  • enabling the submission of application documents related to the recruitment process,
  • making contact details available,
  • making documents and materials available on the Website.

2. Use of the Website and electronic services is generally voluntary and free of charge.

3. The Service Provider may also make available on the Website links leading to external websites, social media services or services belonging to other entities.

§4. Technical requirements

1. Proper use of the Website requires:

  • a device with access to the Internet,
  • an up-to-date web browser,
  • enabled support for technologies necessary for the Website,
  • an active e-mail address – if the User uses features requiring the provision of an e-mail address.

2. Using the recruitment form may require the ability to send files containing application documents.

3. The User should use up-to-date software and device security measures.

4. The Service Provider makes efforts to ensure that the Website is compatible with current versions of the most popular web browsers.

5. The Service Provider does not guarantee the correct operation of the Website on outdated, unsupported or incorrectly configured software.

§5. General rules for using the Website

1. The User is obliged to use the Website in accordance with:

  • applicable law,
  • these Terms of Use,
  • good practice,
  • respect for the rights of the Service Provider and third parties.

2. In particular, it is prohibited to:

  • provide content of an unlawful nature,
  • send content that infringes the rights of third parties,
  • provide other persons' data without an appropriate legal basis,
  • send offensive, vulgar, discriminatory content or content that violates personal rights,
  • send unsolicited advertising information,
  • send spam,
  • use forms in an automated or mass manner,
  • take actions that could disrupt the functioning of the Website,
  • attempt to gain unauthorized access to the Website, the server or other IT systems,
  • send malicious software, viruses or other files that could threaten the security of the systems.

3. If a violation of the Terms of Use is found, the Service Provider may block further use of a given feature, omit or delete a message sent, or take other action necessary to ensure the security of the Website.

§6. Contact form

1. The contact form allows the User to send a message to WestMar Hydraulics.

2. In order to send a message, it may be necessary to provide certain data, in particular:

  • first and last name,
  • company name,
  • e-mail address,
  • phone number,
  • message content.

3. Fields marked as mandatory must be completed in order to correctly submit the form.

4. The User is obliged to provide true, up-to-date data enabling a reply to the inquiry sent.

5. Sending the form causes its content to be transferred to the Service Provider in order to handle the inquiry.

6. Sending the form does not automatically mean that a contract has been concluded between the User and the Service Provider.

7. Sending an inquiry regarding a product, service or terms of cooperation does not mean that an order has been accepted for fulfillment.

8. The terms of any cooperation, order fulfillment or service performance may be agreed separately with the User.

9. The Service Provider makes efforts to respond to messages sent as quickly as possible, however sending the form alone does not guarantee a reply within a specific time.

§7. Recruitment form

1. The Website enables people interested in working at WestMar Hydraulics to submit a recruitment application.

2. Via the recruitment form, a candidate may provide, in particular:

  • first and last name,
  • contact details,
  • information about education,
  • information about professional qualifications,
  • information about professional experience,
  • CV,
  • other documents related to the recruitment process, if required for a given position.

3. The candidate should provide only information relevant from the point of view of the recruitment process.

4. Application documents should:

  • concern the person submitting the application,
  • contain true and up-to-date information,
  • not infringe the rights of third parties,
  • not contain harmful software.

5. If the candidate provides other persons' data, e.g. reference contacts, they should have an appropriate basis for providing this data.

6. Submitting an application does not guarantee:

  • an invitation to a job interview,
  • qualification for the next stage of recruitment,
  • a job offer,
  • conclusion of an employment or other contract.

7. The Service Provider reserves the right to contact only selected candidates.

8. Submitting application documents relating to a specific recruitment process means that data is provided for the purpose of carrying out that recruitment in accordance with the rules described in the information on personal data protection.

9. If the candidate wants their documents to be retained for future recruitment purposes, they may be asked to give separate consent.

10. Lack of consent to participate in future recruitment processes does not affect the possibility of participating in the currently ongoing recruitment.

§8. Files submitted through the Website

1. If the Website enables files to be sent, the User is responsible for their content.

2. It is prohibited to send:

  • files containing viruses or malicious software,
  • executable files unrelated to the purpose of the form,
  • materials infringing copyright or other rights of third parties,
  • files containing unlawful content.

3. For security reasons, the Website may limit:

  • the maximum size of files sent,
  • the number of files,
  • the allowed file formats.

4. Files that do not meet the technical requirements may not be accepted by the system.

§9. Conclusion and termination of the contract for the provision of electronic services

1. The contract for the provision of the service consisting of browsing the Website is concluded at the moment the User starts using the Website and terminates when the User leaves it.

2. In the case of the contact form, the contract regarding the use of this feature is concluded at the moment the User starts using the form and ends after it is correctly sent or after the User resigns from sending it.

3. In the case of the recruitment form, the contract regarding the use of this feature is concluded at the moment the User starts using the form and ends after the application is sent or after the User resigns from sending it.

4. The User may stop using the Website at any time.

§10. Nature of the information published on the Website

1. The information contained on the Website is primarily informational in nature.

2. Information presented regarding products, services, technical capabilities or the Service Provider's activities does not constitute an offer within the meaning of the Civil Code, unless expressly stated otherwise.

3. Detailed terms for the performance of services, deliveries, orders or cooperation may be agreed individually.

4. Photos, visualizations, drawings and materials relating to products are informational in nature, unless expressly stated otherwise.

5. The Service Provider may update information published on the Website, in particular in connection with changes to the offer, product parameters or the scope of services provided.

§11. Availability of the Website

1. The Service Provider makes due diligence efforts to ensure the correct and secure functioning of the Website.

2. Access to the Website may be temporarily limited in particular due to:

  • technical works,
  • software updates,
  • maintenance work,
  • failures,
  • events beyond the Service Provider's control,
  • actions related to system security.

3. The Service Provider may make changes to the Website and its features.

§12. Liability

1. The Service Provider is not liable for problems related to the use of the Website resulting from:

  • the User's failure to meet technical requirements,
  • a failure of the User's device or internet connection,
  • the operation of software installed on the User's device,
  • the actions of third parties over which the Service Provider has no influence,
  • force majeure.

2. The Service Provider is not responsible for the content of data and information voluntarily submitted by the User via forms.

3. The User is responsible for the truthfulness and legality of the information provided.

4. The provisions of these Terms of Use do not exclude or limit the Service Provider's liability in cases where such exclusion or limitation would be inadmissible under applicable law.

§13. Copyright

1. Content contained on the Website, including in particular:

  • texts,
  • photos,
  • graphics,
  • logos,
  • technical materials,
  • designs,
  • graphic layout,
  • visual identity elements,

may be subject to copyright, industrial property rights or other rights belonging to the Service Provider or third parties.

2. Use of the Website does not result in the User acquiring any rights to the materials contained therein.

3. Copying, distributing, modifying or using materials to an extent exceeding permitted use requires an appropriate legal basis or the consent of the authorized entity.

1. Personal data provided through the Website is processed in accordance with applicable personal data protection regulations.

2. Detailed information about their use and the ability to manage consents can be found in the Privacy Policy and Cookies.

3. The User may manage their preferences regarding optional cookies using the mechanism available on the Website.

§16. Complaints regarding electronic services

1. The User may submit a complaint regarding the functioning of the Website or the electronic services provided.

3. In order to enable efficient handling of the complaint, it is recommended to indicate:

  • the type of problem reported,

  • a description of the circumstances,
  • the expected way of resolving the matter.

4. The complaint will be considered without undue delay, taking into account the nature of the reported problem.

5. If handling the complaint requires additional information, the Service Provider may ask the User to provide it.

§17. Reporting security issues

1. If a User notices an error, malfunction, suspicious activity or a potential security threat to the Website, they may inform the Service Provider about it.

2. It is prohibited to use discovered errors in order to:

  • interfere with the operation of the Website,
  • violate security measures,
  • cause damage to the Service Provider or other persons.

§18. Changes to the Terms of Use

1. The Service Provider may amend these Terms of Use, in particular in the event of:

  • changes to applicable law,
  • changes to the Website's features,
  • the introduction of new electronic services,
  • changes to the Service Provider's data,
  • the need to improve the security of the Website.

2. The current version of the Terms of Use is available on the Website.

3. Amendments to the Terms of Use do not affect rights acquired by Users before the amendment came into effect.

§19. Final provisions

1. In matters not regulated by these Terms of Use, the relevant provisions of Polish law shall apply.

2. These Terms of Use concern the use of the Website and the services provided electronically and do not constitute terms of sale of products or the provision of paid services offered by WestMar Hydraulics outside the Website.

3. If a given service, order or cooperation is covered by separate terms or an agreement, the provisions of those documents shall also apply.

4. These Terms of Use are in force from the date of their publication on the Website.
